RULES & REGULATIONS: Eligibility: The Myrtle Beach Dream Vacation (the "Sweepstakes”) is open to all legal U.S. residents and Canadian residents (except Quebec) who are at least 18 years of age, except employees of Oceana Resorts and their affiliates, partners, subsidiaries, franchises, distributors, retailers, advertising and promotion agencies, and the immediate families or household members of each. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law or regulations. Oceana Resorts customers will be entered into the drawing each time a qualifying vacation is completed with Oceana Resorts. To be eligible for the Sweepstakes, online entries must be received between 12:00 p.m. Eastern Daylight Time (EDT) on May 1, 2009 and 12:00 p.m. Eastern Standard Time (EDT) on August 31, 2010 (the "Sweepstakes Period"). Oceana Resorts reserves the right to end the Sweepstakes earlier than August 31, 2010 in the event the total entries have reached 10,000 (ten thousand.) All entries and requests become the property of Oceana Resorts and will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Prizes: One (1) Condo Prize winner (Grand Prize) will receive fee simple title to a one-bedroom fully-furnished oceanfront condominium unit located in the Anderson Ocean Club & Spa, 2600 North Ocean Boulevard, Myrtle Beach, SC 29577. Prize value: $340,000 (based on recent appraised value). One (1) Auto Prize winner (Second Prize) will receive a 2010 Ford Focus Hybrid automobile. Thirty-eight (38) Special Prize winners will receive prizes as follows: 3rd Prize: a $2,000 shopping spree at Coastal Grand Mall. 4th Prize: a $2,000 shopping spree at Tanger Outlet Mall. 5th Prize: a $2,000 shopping spree at Best Buy. 6th Prize: a $1,500 shopping spree at Coastal Grand Mall. 7th Prize: a $1,500 shopping spree at Tanger Outlet Mall. 8th Prize: a $1,000 shopping spree at Coastal Grand Mall. 9th Prize: a $1,000 shopping spree at Tanger Outlet Mall. 10th Prize: $ 1,000 shopping spree at Best Buy. 11th - 20th Prizes: 10 winners will receive a $500 Myrtle Beach Dining Package at Divine Dining Group. 21st- 40th Prizes: 20 winners will receive a $200 gift certificate for the Awakening Spa and Salon exclusively at the Anderson Ocean Club & Spa. Selection of winners: The Condo Prize Winner, Auto Prize Winner and selected other Special Prize Winners will be determined by a random drawing by Oceana Resorts no later than September 1, 2010 from eligible entries submitted during the Sweepstakes Period. The prize drawings will be conducted by representatives of Oceana Resorts, whose decisions are final and binding in all matters relating to this Sweepstakes. The Condo Prize, Auto Prize and selected other Special Prize drawings will be held at the Anderson Ocean Club & Spa or an alternative location to be selected and announced by Oceana Resorts no later than 30 days prior to the drawing. Winners need not be present at the drawing to win. Oceana Resorts may publish the names and addresses of the prize winners on its web site or other promotional materials at its sole discretion. Oceana Resorts reserves the right to substitute prizes of equal or greater value. Winner will be notified by telephone, mail, or e-mail within five (5) days and will be given instructions on how to claim the prizes. Winner will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, publicity release) within five (5) days of notification or prize will be forfeited and awarded to an alternate winner. Odds of winning are: Overall odds of winning any prize are approximately 1 in 250. Odds of winning the Condo Prize (Grand Prize) are approximately 1 in 10,000. Odds of winning the Auto Prize (Second Prize) are approximately 1 in 10,000. Overall odds of winning a shopping spree are approximately 1 in 1,250. Overall odds of winning a dining package are approximately 1 in 1,000. Overall odds of winning a spa package are approximately 1 in 500. Odds of winner are subject to change depending on participation. Release of Liability: By participating, you release Oceana Resorts, and their subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of this Sweepstakes, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, incidental or consequential damages of any and all rights to have damages or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. Oceana Resorts is not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmissions of or failure to receive entry information by Oceana Resorts on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Oceana Resorts, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Oceana Resorts reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify, or terminate the Sweepstakes if Oceana Resorts believes, in its sole discretion that malfunction, error, disruption or damage, is impairing or will impair the administration, security, fairness, integrity, or proper play of the Sweepstakes. If Sweepstakes is terminated before the end date, Oceana Resorts will determine the winner from all eligible entries received as of the termination date. Cash in Lieu of Prizes: A winner may elect to receive cash in lieu of the designated prize. The following cash amounts may be substituted for the advertised prize at the winner's sole discretion. Condo Prize (Grand Prize): $200,000. Auto Prize (Second Prize): $12,000. 3rd - 6th Prize: $1,000 each. 7th- 10th Prize: $750 each. 11th - 20th Prize: $250 each. 21st - 40th Prize: $50 each. Taxation and Other Potential Costs: All prizes may be subject to local, state or federal taxation. All winners are responsible for any tax liability that may be incurred as a result of winning a prize. There are costs of ownership associated with the Condo Prize (Grand Prize), including but not limited to, real estate taxes, personal property taxes, closing costs, homeowner association dues, and insurance. There are costs of ownership associated with the Auto Prize (Second Prize), including but not limited to, fuel, maintenance, insurance, licensing and registration.
